Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Noctessa platform (“the Service”), operated by Anel Saloski, sole proprietor, North Macedonia (“Noctessa”, “we”, “us”). By registering for or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
Noctessa is a multi-tenant software-as-a-service platform for hospitality and event venues. It provides each venue a branded booking site, reservation and floor-plan management, admin tools, QR e-ticketing and social publishing. We provide the software; the venue operates its own site and runs its own business on it.
Accounts
To use the Service a venue registers an account and is responsible for keeping its credentials confidential, for all activity by its staff and admin users, and for providing accurate and current account information. You are responsible for everything that happens under your account.
Subscription & billing
Paid plans are billed at EUR 99 per month or EUR 999 per year and start with a 7-day free trial. Billing is handled by our Merchant of Record, Creem, who is the seller of record for the transaction; Creem's Buyer Terms also apply to your purchase. Subscriptions renew automatically for successive periods until cancelled. You authorise recurring charges until you cancel.
Acceptable use
You may not use the Service for any illegal, infringing or abusive purpose. Each venue is the data controller for its own guests' data and is solely responsible for any payments it collects from its guests — those are processed through the venue's OWN payment provider, and Noctessa never processes or holds guest or ticket payments.
Intellectual property
Noctessa and its licensors own all rights in the platform, its software, design and trademarks. You retain all rights in the content you upload (events, images, venue information); you grant us the limited licence needed to host and display that content in order to operate the Service for you.
Disclaimers & liability
The Service is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Noctessa is not liable for any indirect, incidental or consequential damages, or for loss of profits, data or goodwill arising from your use of the Service.
Term & termination
You may cancel at any time; access continues until the end of your paid period. We may suspend or terminate access for breach of these Terms or non-payment. On termination we delete or return your data in line with our Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Service or by email; continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of North Macedonia, without regard to conflict-of-laws rules.
